House of Blues freight elevator subject of lawsuit over delivery mishap

28-May-14 – A freight elevator at House of Blues that serves rocks stars and delivery people is involved in a lawsuit filed by a man who says he was injured on the elevator last year.

James McGinley says on March 22, 2013, at about 9:30 a.m., he was on the elevator when an employee or agent of Sysco Corporation, the food distributor, closed the door of the elevator but did not see that McGinley was in the way. Without warning, McGinley says he was hit on the head by the door, sustaining “serious and permanent injuries” for which he has had to seek “extensive medical consultation and treatment.”

He filed his lawsuit on November 26, 2013, claiming the elevator was improperly operated, managed, maintained, controlled, inspected, and supervised. Defendants are HOB Chicago, Inc., Sysco Chicago, Inc., and Sysco Corporation.

McGinley is seeking a jury trial and in excess of $50,000. An amended complaint was filed on May 13, 2014, and a status hearing is scheduled for June 5.
