Condo association takes possession of Kimmel units Kimmel now doing time at Leavenworth 23-Sep-09 – Gary Kimmel, the former Marina City resident now serving a 20-month prison sentence for money laundering, has lost possession of his three condominium units at Marina City to Marina Towers Condominium Association. On August 20, MTCA won an order for possession of Kimmel’s three combined units on the 56th floor of the east residential tower. The condo association sued Kimmel on May 14 for $5,848.23. On June 12, judgements in favor of MTCA were ordered by Municipal Division Judge Orville E. Hambright, Jr.
One legal issue in Cook County ended better for Kimmel. On July 24, a lawsuit by J. P. Morgan Chase was dismissed without prejudice, meaning the plaintiff can re-file at a later date. Chase had sued on February 6 for $10,951 over a contract dispute. The bank tried unsuccessfully for a year to serve Kimmel with a summons. Also this year, MB Financial Bank won a $17,373 judgement against Kimmel that had been filed on February 13. Again, a summons was returned unserved multiple times, but by March 2 Kimmel was at the penetentiary in Marion, Illinois. An “ex-parte judgement,” decided in Kimmel’s absence, was allowed on August 12. In 2007, Daimler Chrysler filed three lawsuits against Kimmel – for $17,451, $15,252, and $17,194, presumably over car loans. They won all three suits for the full amounts. Three mortgages on unit this year Documents from the Cook County Recorder of Deeds show three mortgages on the property recorded this year. The mortgages were given by Paul Zido, one of Kimmel’s defense attorneys. On January 26, two mortgages totalling $65,000 were granted – one to Mona Lisa Kimmel, Gary’s wife, for $35,000 and a second to Gary for $30,000. A third mortgage, on July 15, was to Gary for $64,107. Zido had no comment on the mortgages when contacted earlier in the year by Marina City Online.
Kimmel moved to Kansas, release date moved up According to the Federal Bureau of Prisons, Kimmel is currently incarcerated at the United States Penitentiary in Leavenworth, Kansas. He was moved on July 6, according to Michelle Edge, Case Management Coordinator at USP Marion, where Kimmel started his sentence on March 2, 2009. Leavenworth was a maximum security prison until 2005, when it was converted to a medium-security facility housing male inmates. It is located 25 miles north of Kansas City. Notable prisoners include gangsters George “Bugs” Moran and George “Machine Gun” Kelly, and former NFL quarterback Michael Vick.
Kimmel is now 60 years old. His release date has been moved up from November 7, 2011 to November 28, 2010.
